Buying Property in Baja California
Tijuana, Rosarito and Ensenada are in Mexico’s restricted zone. Foreigners can buy residential property there, usually through a bank trust (fideicomiso).
Before you sign a purchase agreement or send a deposit, we review the property, the contract and the trust with you, so you know exactly what you are buying.
Understand the deal before you sign
In the restricted zone (100 km from the border and 50 km from the coast), a Mexican bank holds title through a fideicomiso and you keep the rights to use, rent and sell the property.

What we review with you
LEGAL DUE DILIGENCE, EXPLAINED
• Title, liens and the legal history of the property.
• Ejido land and other ownership risks.
• Who has the legal right to sell.
• Presale contracts with developers.
• Unpaid property tax, water and HOA fees.
We also explain closing costs, notary fees and the tax duties that apply if you plan to rent the property out.

BEFORE THE NOTARY
The notary certifies the transaction. A consultation helps you decide whether to go ahead, and on what terms, before you reach the notary’s office.
If the purchase needs contract negotiation, a written title review or follow-up through closing, we will define the scope and fees in a separate proposal.

Support that fits your needs
IF YOU NEED FURTHER HELP
A single consultation is often enough to guide your next decision. When a matter requires negotiation, paperwork or representation in Mexico, we can discuss further work.
Any additional work is agreed separately, with a defined goal and scope. The decision to hire us is always yours.
